It is strongly recommended that at all times to have at least a simple will ensuring  that your wishes are clear on your death and that the correct people benefit.  Wills should be reviewed every 6 to 10 years.  This can be quick and efficient if you use a lawyer that is already familiar with your affairs.  You do not have to start from scratch if you have an existing will as you can make changes or additions by making a Codicil.
When someone dies, no one can access their assets so official authority interveens.  However if there is a will in place setting out the wishes of the deceased Probate can be obtained.  The rules of intestacy applies if there is no will and the distribution of assets is often not in accordance with the deceased wishes.  An Administrator is appointed, the Executor or Administrator collects in all the assets pays all the debts tax liablities and then distributes the net balance.
